作者: Kan-Tor & Acco律师事务所高级研究员Ravit Bakrach   我们最近协助了一家中国国有企业取得众多的技术工人工作许可证,这些技术工人受雇在能源领域建立一个预计为期五年的项目。这是个复杂的项目,成本估计为20亿新谢克尔,并使用以色列没有的独特设备和技术。这类项目需要具有特殊技能的外国工人,只有他们具备操作这些从外国而来之特殊机械和设备的知识,如果不引入这些工人,这个项目将无法被完成。   有个雇用外国技术工人的程序就是为了解决雇用外国劳动力的问题,且不需满足以色列对外国专家在工资上要达到双倍工资的要求。这些工人具备以色列没有,但为操作以色列基础设施项目中特殊技术和机械所需的技能。这些机具的操作与维护只有外国工人才能掌握。   该程序特别在公共项目中被施用,这些项目有预定好的时间表、地点和工作范围。在这样的情况下,政府可一次为大量的外国技术工人发放工作许可证。一个重要的好处是可根据项目整体时间发放对等时效的工作许可证。从雇主的角度而言,这些外国工人的工资对标的是集体谈判协议的水平,集体谈判的工资远低于外国专家薪酬,约为其一半。   许可证的发放须经过咨询委员会同意,该委员会由人口和移民局、财政部、劳动和社会福利部以及建设和住房部的代表组成。迄今为止,以色列已为铁路建设、港口建设,和名为”约旦河之力”的抽水蓄能电站等项目发放了技术工人许可证。   有鉴于此,为增加这些许可证被批准的机会:建议咨询具有经手外国工人工作签证签发程序经验,并专精处理复杂建筑和基础设施项目许可的律师。这样的律师熟悉审核程序和考量标准,可协助准备相关文件以提出充分周全的申请。提交不详又缺少证明文件的申请,将导致受批准之工作许可数量的减少,甚至导致申请被全数拒绝。
